By completing online registration and electronically accepting this agreement, I (“Participant”) acknowledge that I have read, understand, and agree to the following Online Waiver & Release of Liability in connection with participation in all activities offered by Casa Pickle (“Club”), including open play, leagues, tournaments, clinics, lessons, rentals, and other programming (“Activities”).

1. Assumption of Risk

I understand that participation in pickleball and related Activities involves inherent risks including, but not limited to: slips, falls, collisions, overexertion, equipment failure, uneven surfaces, weather conditions, and other risks that can result in injury, illness, permanent disability, or death. I voluntarily assume all risks, whether known or unknown, including risks arising from the negligence of the Club or others.

2. Release and Waiver of Liability

On behalf of myself, my heirs, personal representatives, and assigns, I hereby release, waive, discharge, and agree not to sue Casa Pickle, its owners, officers, directors, employees, agents, volunteers, sponsors, and affiliates (collectively, “Released Parties”), from any and all claims, demands, causes of action, damages, liabilities, losses, costs, and expenses (including attorney’s fees) arising out of or relating to my participation in Activities, including those caused by the negligence of the Released Parties, to the fullest extent permitted by law.

3. Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or related to my actions, omissions, or participation in Activities, including claims by third parties.

4. Medical Treatment Authorization

In the event I am injured or require medical attention during Activities, I consent to receive medical treatment deemed necessary by medical professionals. I agree that I am solely responsible for any and all costs associated with medical care, transportation, or rehabilitation.

5. Physical Fitness and Eligibility

I certify that I am physically capable of participating in all Activities offered by Casa Pickle. I understand that the Club recommends consulting with a physician prior to participation if I have any medical conditions or concerns.

6. Rules and Safety

I agree to follow all Club rules, safety protocols, facility policies, and instructions provided by staff or authorized representatives. I understand that failure to comply may result in removal from Activities without refund.

7. Communicable Disease Acknowledgment

I acknowledge that participating in Activities may expose me to communicable diseases, including but not limited to viruses such as COVID-19. I voluntarily assume all risks associated with exposure and agree to comply with all health and safety protocols required by the Club or authorities.

8. Media Release

I grant the Club and its designees the irrevocable right to use, reproduce, distribute, and publish my image, voice, or likeness captured in photographs, videos, or other media taken during Activities for promotional, marketing, or educational purposes, without compensation.

9. Electronic Agreement

I agree that this waiver and release is valid and enforceable as an electronic agreement, and that my electronic acceptance (e.g., checking a consent box or clicking “I Agree”) constitutes a legally binding signature with the same force as a handwritten signature.

10. Severability

If any term or provision of this agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
